POLICY AND SERVICE GUIDELINES
Aloha Web Hosting has a responsibility to ensure that each of our clients is provided with the best services we have available. While we back up files continuously, we are in no way responsible for the archiving of a site. It is the sole responsibility of the site creator to copy, back-up or archive all files that constitute a web site.
The following guidelines also apply:

Content:
All services provided by Aloha Web Hosting may be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material in violation of any United States Federal, State, or City law is prohibited. This includes, but is not limited to copyrighted material, material we judge to be threatening or obscene or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Aloha Web Hosting from any claims resulting from the use of the service, which damages the subscriber or any other party.

Pornography and sex-related merchandising is prohibited on all Aloha Web Hosting servers. This includes sites that may infer sexual content or links to adult content elsewhere. Aloha Web Hosting will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to Aloha Web Hosting servers or any other server on the Internet. Links to such materials are also prohibited.
Examples of unacceptable content or links:
- Pirated software
- Hacker programs or archives
- Warez sites

Aloha Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Unlimited Traffic/Courtesy Policy.
We are pleased to offer our clients unlimited Web page traffic (standard and above plans) with the only consideration being our Courtesy policy. This Policy has been created so that one customer does not take an unfair portion of server traffic, a situation that for 99% of our customers is never a consideration. To maintain the integrity of our service, the following restrictions apply:

- Sites offering download files. (This is any site where 20% or more of their monthly traffic is from file downloads)
- Sites using more than 20% of system resources.

Aloha Web Hosting will be the sole arbiter as to what constitutes a violation of this provision

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from an Aloha Web Hosting server or using an email address or domain that is maintained on an Aloha Web Hosting machine as reference is STRICTLY prohibited. Aloha Web Hosting will be the sole arbiter as to what constitutes a violation of this provision.

Chat Rooms
We do not allow clients to install their own chat rooms. These tend to be a large drain on system resources and we cannot allow it as an account option

Background Running Programs
We may allow programs to run continually in the background. These are considered on a case-by-case basis and an extra charge will be incurred based on system resources used and operational maintenance needed.

IRC
We currently do not allow IRC or IRC bots to be operated on our servers.

Domain Pointing
Domain pointers are to be used for the purpose of having more than one way to find the same site, not for the purposes of sharing an account among multiple sites. A domain pointer may not be set up to reference a subdirectory within an existing Web hosting account served by Aloha Web Hosting or any other provider.

Server Abuse:
Any attempt to undermine or cause harm to a server, or customer, of Aloha Web Hosting is strictly prohibited, and will result in immediate termination or prosecution.

Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Billing Problems and Termination:
Accounts paid by credit cards which are rejected by our online card processor are grounds for termination. Because of the risk of credit card fraud, any account which offers two bad credit cards within any 6 month period will be subject to immediate termination.

Domain Registration Services :  registration period is preset to 2 years. If you do not change this, all of your domains will registered for two years and the charges will reflect two years worth of registration fees, which are non-cancelable and non-refundable due to real time registration. 

BulkRegister maintains a NO REFUND policy due to the transaction
process being real-time.  This information is stated on our web site
(http://www.bulkregister.com) under the paragraph titled, Payment as
well as on the page through which one registers to become a member. 
When deleting a domain name, please be aware that the deleted name
will not add a credit to ones BulkRegister account.  The charges will
still remain.  We have a "confirmation" feature on our site to
prevent any faulty submissions or deletions.  When transactions are
processed real-time because of our automated, sophisticated system
and since we interface with Network Solutions Inc. (the registry),
the payment is received immediately.  Please be sure to read our web
site thoroughly for further information.

Money Back Guarantee:

 Aloha Web Hosting is pleased to offer a money-back guarantee within 30 days of your account activation should we fail to provide satisfactory service. We do not refund InterNIC registration fees. Furthermore, Aloha Web Hosting will not and can not be responsible for any fees that you charge for your services to your customers.

DISCLAIMER:

 Aloha Web Hosting cannot be held liable for system downtime, crashes, or data loss. We cannot be held liable for any predicted estimate of profits in which a client would have gained if their site was functioning. Certain services provided by Aloha Web Hosting are resold. Thus, certain equipment, routing, software, and programming used by Aloha Web Hosting are not directly owned or written by Aloha Web Hosting. Moreover, Aloha Web Hosting holds no responsibility for the use of our clients accounts. Aloha Web Hosting cannot be held liable for any 3rd party (resold) accounts. Reseller is totally responsible to and for any resold accounts purchased from Aloha Web Hosting. If any terms or conditions are failed to be followed, the account in question will be automatically deactivated. We reserve the right to remove any account without advanced notice for any reason without restitution as Aloha Web Hosting Solutions sees fit.

Cancellations Fee:

Cancellation of any account by customer before contract due date will result in a cancellation fee and will revoke any and all discounts given.



Account Activation:

By activating your account with Aloha Web Hosting, you agree to the above policies and disclaimer. Upon requesting an account activation, you are required to accept these policies, guidelines, and disclaimer and a copy of your acceptance is forwarded along with your activation request to be maintained within your account information.


NOTICE: If you sign up for an account and do not follow our terms, no refunds will be given. We will however let you know by email or phone before any action is taken so that you have the opportunity to resolve the matter.

 Aloha Web Hosting retains the right to change any or all of the above Policies, Guidelines, and Disclaimer without notification.
All Sub-Networks, distributive hosting sites and dedicated servers of Aloha Web Hosting must adhere to the above policies.

Failure to follow any term or condition will be grounds for immediate account deactivation.
